Estate planning involves arranging for the management and disposition of your estate upon your incapacity or death. A typical estate plan includes the preparation of Wills, Trusts, Powers of Attorney, Health Care Proxies and Living Wills. In second marriages, the issuer can become more complex and might involve additional documentation that should be considered.

Medicaid: The costs of long-term care can be expensive and are not covered by Medicare or typical health insurance policies. Such care can be covered by Medicaid, however there are certain asset and income tests and an exhaustive application process in order to qualify for Medicaid. The application process can be daunting, but Hyl Conte Law assists clients in assembling the documentation they need to support the application and facilitate the process.
Guardianship: In terms of Guardianship, there are 2 types of guardianship proceedings in New York. Those for people who are born with a developmental or mental disability and therefore never had capacity; and the second for those who did have capacity but subsequently lost capacity, either as a result of injury or illness. The laws, procedures, Courts and paperwork are completely different between the two. Special Needs Planning:
For our clients necessitating Special Needs Planning, Hyl Conte Law helps our clients understand the circumstances and instances which could jeopardize eligibility for governmental benefits and programs; such as how funds left to a disabled individual could jeopardize their eligibility for governmental benefits and programs if not placed into a Special Needs Trust, also known as a Supplemental Needs Trust. Additionally, depending on the severity of the limitations of the disabled individual, they may need more or less than what would be their traditional share of the estate.

Probate: When a loved one dies, someone needs to be appointed to act on behalf of their estate. This appointment must be obtained in the Surrogate’s Court. As such, Hyl Conte Law prepares all of the necessary Court paperwork to obtain these appointments, and continue to advise clients on the steps they need to take to administer an estate once they are appointed.
Trust Administration: Trusts are established for a variety of reasons. As time passes, the need for the Trust and the management of the Trust can go through various changes.
